1. Acceptance of Terms

By downloading, installing, or using the Carplate mobile application (hereinafter — the App), you confirm that you have read, understood, and agree to be bound by these Terms of Use (hereinafter — the Terms).

If you do not agree with these Terms, immediately cease using the App and uninstall it from your device.

2. Description of the App

Carplate is an iOS mobile application that provides access to Ukrainian government open vehicle registries. The App allows you to:

Search for vehicles by license plate number.
Scan license plates using the device camera.
Upload photos from your gallery for license plate recognition.
View registration data (make, model, year, VIN, color, type, etc.).
Check whether a vehicle appears in the wanted registry.
Save vehicles to a favorites list and receive notifications about status changes.
Browse the reference guide to Ukrainian regional license plate codes.

The App uses open data published on the data.gov.ua portal in accordance with Ukrainian open data legislation.

3. Registration and Account

3.1 Registration Requirements

To access the App's features, you must create an account. When registering, you agree to:

Provide accurate and up-to-date information.
Be at least 18 years of age.

Registration is available via three methods: - Email and password — direct registration with your credentials. - Sign in with Apple — sign in using your Apple ID account. - Sign in with Google — sign in using your Google account.

When using a third-party sign-in (Apple, Google), you also agree to the terms of the respective provider. We receive only the data you grant during authorization (identifier, email, name).

3.2 Account Security

You are responsible for:

Keeping your password confidential (when signing in via email).
The security of your Apple ID or Google account (when signing in via them).
All actions taken using your account.
Immediately notifying us of any unauthorized access to your account at avtierzov@gmail.com.

We are not liable for any damages arising from unauthorized use of your account due to your failure to adequately protect your credentials.

3.3 One Account per Person

Each person may hold only one account regardless of the registration method used. Registering multiple accounts by the same person is prohibited.

4. Device Permissions

For full functionality, the App may request the following permissions on your device:

Camera — for real-time license plate scanning. Images are processed exclusively on your device and are never transmitted to our servers.
Photo Library — for selecting a photo from your gallery for license plate recognition. Photos are processed exclusively on your device and are never transmitted to our servers.
Push Notifications — for receiving notifications about status changes of favorited vehicles.

Denying camera or photo library permission does not restrict the text-based search feature. Denying push notification permission will only disable the corresponding alerts.

5. Acceptable Use

5.1 Permitted Use

Personal, non-commercial searches for vehicle information.
Saving vehicles to favorites and monitoring them for lawful purposes.
Checking your own vehicles.

5.2 Prohibited Use

You may not:

Engage in bulk data collection — automated large-scale downloading of registry data (scraping, bots, automated queries) without the developer's written permission.
Violate applicable law — use the App for any purpose that conflicts with applicable Ukrainian law, including surveillance, stalking, or infringement of the rights of others.
Attempt to compromise the system — make any attempt to gain unauthorized access to servers, databases, or other infrastructure components.
Resell or commercialize — provide paid access to App features or to data obtained through the App to third parties without the developer's written consent.
Circumvent technical restrictions — attempt to bypass any access restrictions, rate limits, or the authentication system.
Impersonate another person — register using another person's personal data or another person's Apple/Google account.
Distribute malicious software — upload or transmit any malicious code through the App.

6. Data Sources and Accuracy

6.1 Open Government Data

Vehicle information in the App is sourced from open registries published on data.gov.ua pursuant to the Law of Ukraine "On Open Data" and provided by the Ministry of Internal Affairs of Ukraine. Data is updated as official registry updates are published.

6.2 Disclaimer of Accuracy Warranties

We do not guarantee:

Completeness — the registry may not include all vehicles or all registration actions.
Timeliness — there is a technical delay between an official registry update and its display in the App.
Accuracy — data is reproduced as published by government authorities; we make no modifications and are not responsible for errors in primary sources.

For any legally significant actions, contact the relevant official authorities (the National Police of Ukraine, MIA service centers) to obtain officially certified records.

6.3 Wanted Registry

The presence or absence of a vehicle in the wanted registry is informational only and cannot be used as legal evidence. For official information, contact the appropriate authorities.

7. Intellectual Property

7.1 Developer's Rights

All content of the App, including but not limited to: source code, design, interface, logo, the name "Carplate" (Карномер), license plate recognition algorithms, and documentation, is the property of Andriy Tierzov and is protected by Ukrainian copyright and intellectual property law.

7.2 Limited License

The developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

Copy, modify, or create derivative works based on the App.
Distribute or publicly display the App.
Reverse-engineer or decompile the App.
Remove or alter any copyright or other proprietary notices.

7.4 Open Registry Data

Vehicle data is public pursuant to Ukrainian law. We make no ownership claims regarding such data.

8. Privacy

The collection and processing of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms. Please review it before using the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND — EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Warranties of fitness for a particular purpose.
Warranties of uninterrupted or error-free operation.
Warranties as to the accuracy, completeness, or timeliness of data.
Warranties of compatibility with specific devices or operating systems.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

Any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.
Damages arising from errors, inaccuracies, or missing information in the registries.
Decisions made based on information obtained through the App.
Technical failures, service interruptions, or data loss.
Any acts or omissions of third-party providers (Apple, Google, Gravatar).

In any event, the developer's total liability shall not exceed the amount paid by you for the App (if any) in the preceding 12 months.

11. Suspension and Termination of Access

11.1 Developer's Rights

The developer reserves the right to suspend or terminate your access to the App without prior notice in the event of:

Your violation of these Terms.
Detection of fraudulent or unlawful activity on your part.
Technical necessity or significant changes to the App's functionality.
Discontinuation of the service.

11.2 User's Rights

You may cease using the App and delete your account at any time by contacting us at avtierzov@gmail.com or through the relevant feature within the App.

11.3 Effect of Termination

Upon deletion of your account, your personal data will be deleted in accordance with the Privacy Policy, except for data whose retention is required by law.

12. Third-Party Services

The App interacts with the following third-party services:

Apple Inc. — Sign in with Apple, Apple Push Notification Service (APNs). Governed by Apple's terms.
Google LLC — Sign in with Google. Governed by Google's terms.
Gravatar (Automattic Inc.) — for generating user avatars.
data.gov.ua — the Ukrainian government open data portal.

We are not responsible for the availability, accuracy, or terms of use of third-party services.

13. Changes to the Terms

We reserve the right to amend these Terms. We will notify you of material changes through:

Push notifications within the App.
A notice displayed at the next App launch.

Continued use of the App after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the changes, please uninstall the App and contact us to delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Ukraine.

Any disputes arising in connection with these Terms or the use of the App shall be resolved through negotiation. If an amicable resolution cannot be reached, disputes shall be submitted to the courts of Ukraine at the developer's place of registration in accordance with applicable law.

15. Severability

If any provision of these Terms is found by a court to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
